Grandparents Don’t Have Automatic Visitation Rights in Texas
Texas Family Code Sections 153.432 through 153.434 provide a limited route for a biological or adoptive grandparent to request possession of or access to a grandchild. These provisions don’t create an automatic right to visitation or custody.
A grandparent generally must overcome the parental presumption, the legal starting point that a fit parent acts in the child’s best interest. This requires showing that denying access would significantly impair the child’s physical health or emotional well-being. Evidence that continued contact would benefit the child, without proof of meaningful harm from its denial, generally isn’t enough.
Changes to Texas law effective September 1, 2025, further reinforced the presumption favoring a parent’s decisions in disputes with nonparents. Attorney Mora can explain how these standards apply to your family’s circumstances without overstating the likelihood of access or conservatorship.
Who Has Standing to Seek Grandparent Access in Houston?
Standing is the legal authority to bring a claim before the court. Under the grandparent access statute, a grandparent must be the parent of the child’s mother or father, and that parent must fall within at least one qualifying circumstance.
The child’s parent generally must:
- Have been incarcerated during the three months before the case was filed.
- Have been found incompetent by a court.
- Be deceased.
- Have no court-ordered possession of or access to the child.
If both parents are fit, present, and jointly deny contact, a grandparent generally won’t have standing under this statute. Other provisions may offer separate routes for certain relatives or people who have provided substantial care, but those claims depend on different facts and deadlines.
A request for visitation or custody proceeds through a Suit Affecting the Parent-Child Relationship (SAPCR), which asks a court to decide issues involving a child. The SAPCR is generally filed in the Texas county where the child lives. Cases involving children who live in Houston may proceed through the Harris County Family District Courts.
How Conservatorship Differs From Grandparent Visitation
Conservatorship is the Texas legal term for the rights and responsibilities commonly associated with custody. It differs from a request for scheduled possession and access. A nonparent seeking custody faces a demanding standard and must overcome the presumption favoring a fit parent, with the required proof depending on the type of claim and the family’s circumstances.
Relevant evidence may address:
- The history and stability of the relationship between the grandparent and child.
- The grandparent’s previous role in providing daily care.
- The child’s physical, emotional, educational, and medical needs.
- The condition of the child’s current living environment.
- The specific harm that could result from denying access or leaving the current arrangement unchanged.
Attorney Mora works directly with each client to identify records, witnesses, prior court orders, and other evidence that may be presented in Harris County family court. If a child’s safety requires immediate court involvement, our practice also handles emergency proceedings, including petitions for temporary restraining orders.
Existing custody orders can change the available legal strategy. A modification of custody orders requires a separate factual and legal analysis, including whether the circumstances meet Texas modification standards.
Direct Access to Your Attorney at Every Stage
Establishing standing, gathering evidence, responding to a parent’s objections, and preparing for court can take time. Mayra Mora remains directly involved at every stage, so you can ask her about the legal standard, the evidence, and the next procedural step without being passed among staff members.
During the initial consultation, Attorney Mora evaluates the available facts, explains potential obstacles, and outlines the fee structure and anticipated costs. You’ll understand the legal and financial considerations before deciding whether to proceed.
Our firm serves clients throughout Houston and Harris County, with communication available in English and Spanish.
